Previously on "Intellectual Property Theft By FleaBagHead"...

Regular readers will recall that we took a look at the glowing customer "testimonials" on X3Host's website and discovered that those customers didn't exist and that FleaBagHead was just playing make-believe with his imaginary friends from the Deposit Photos stock image site.

Today we're going to talk about one of the most exciting topics in the world: legal terms and conditions.

X3Host - which, let me remind you, has been a hugely successful web host since 1694 with approximately 14.2 billion happy users - has four legal/quasi-legal documents on its site. They are:

Green Web Hosting
Privacy Policy
Term of Service
Acceptable Use Policy

Let's start with the Acceptable Use Policy. It really is a riveting read.

Now, there are some problems with X3Host's AUP. Not least the fact that they appear to condone child pornography:

When I was at school a tick from a teacher was a mark of approval, so...

Unfortunate, let's put it that way.

But there's another problem. And that is that the X3Host Acceptable Use Policy seems familiar.

Perhaps because it's the same one used by Take 2 Hosting...

Now, at this point I must be fair FleaBagHead.

The Acceptable Use Policy used by X3Host and all the other hosts mentioned above comes from a book called Drafting Internet Agreements by Gregory J. Battersby, Charles W. Grimes and Leonard T. Nuara.

If you publish a book full of legal documents you'd be dumb not to realise that some even dumber people might just copy and paste those documents without knowing what they were doing.

But the book is clear: its contents are copyrighted:

Now, we all know that FleaBagHead runs one of the world's leading web hosts and has done since 1475.

Therefore I'm absolutely 100% certain that FleaBagHead will have approached the publisher of the book to obtain a licence to use the sample as the basis for X3Host's Acceptable Use Policy.

In fact, I'm so certain of that fact that


I challenge said FleaBagHead to produce a copy of the valid and signed licence agreement and post it on this thread. If he/she/it does so, I will donate £1,000 to the charity of FleaBagHead's choice. And I will post proof of making that donation.


So that's the Acceptable Use Policy.

What about the X3Host Term [sic] of Service?

Well, roger me sideways with a cucumber wrapped in sandpaper. FleaBagHead's only gone and done it again.

Hilariously, X3Host's Terms of Service contain a misspelling in its Force Majeure clause:
Quote:X3Host shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond X3Host’s control, including, without limitation, signification failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.

"Signification". Hmmm...

But the exact same spelling mistake in exact copies of the same set of Terms of Service also appears on the website of the world-famous marveloushost.com, which seems to operate from Egypt:

Did X3Host copy MarvelousHost or did MarvelousHost copy X3Host?

Who knows?

But if you correct "signification" to "significant", well, then Google serves up 2,080 results.

Including...

Take 2 Hosting (yes, them again)...

So, to summarise where we're at right now:

1. X3Host and FleaBagHead make up client testimonials from stock photos. (Who knows whether FleaBagHead bought a licence for those stock photos. Even if he/she/it did, he/she/it has not given the appropriate credit to the photographer and to Deposit Photos that are required under Deposit Photos' licence agreement.)

2. X3Host and FleaBagHead have infringed the copyright of the original authors of their Acceptable Use Policy.

3. X3Host and FleaBagHead EITHER were so stupid that they stole their Term [sic] of Service from someone at MarvelousHost who can't spell the word "significant" OR they infringed the copyright of one of approximately 2,000 web hosting companies.

Two documents down, two to go. Let's move on to X3Host's Privacy Policy

Things don't start well for FleaBagHost with this one because he/she/it didn't even bother to change the placeholder text "[email address]" in the first paragraph:

Funnily enough, our old friends at MarvelousHost almost fell into the same trap. They did at least manage to remove "email address" and change it to info@marveloushost.com, but they left the square brackets in.

But our Egyptian friends at HostSailor.com weren't quite so on the ball:

Now that's intriguing. Who do we know who would make three errors in three sentences?

1. "It described..." should be "It describes...".
2. "...what are company policies are..." should be "...what our company polices are..."
and
3. "[email address]"

So I had a look at HostSailor's Terms of Service.

Well, I would have done but I got this message:

Does that message look familiar to any X3Host customers by any chance...?

Fortunately, Google has cached HostSailor's Terms of Service.

And - who'd a thunk it? - they are almost identical to X3Host's Term [sic] of Service, right down to the last spelling mistake!

There are just two clauses in HostSailor's Terms that are not in X3Host's terms. Impossible to say whether FleaBagHead stole the terms from HostSailor and deleted those two clauses, or whether HostSailor stole the terms from X3Host and added those two clauses.

Both companies are apparently based in Dubai.

Though neither company hosts its own website there: X3Host goes for the legendary ioflood.com servers in Phoenix, Arizona...

...while HostSailor's IP address resolves to the Netherlands.

You know, I'm sure FleaBagHead has talked about having a server in the Netherlands before.

Just another of the remarkable coincidences between X3Host and HostSailor.

But we've got one more document to go. Hang in there, everyone. The finishing line is in sight.

Let's have a look at X3Host's Green Web Hosting page.

I think we can all agree that you'd have to be a tremendous fuckwomble to lie or cheat when it comes to claiming to be an environmentally-conscious business.

So let's see what X3Host has to say about itself:

So, FleaBagHead has not only nicked HostUpon's green text but he/she/it has also stolen their graphics to claim green credentials.

What a disgraceful, pathetic act.

So FleaBagHead's customers are stock image photos; his Acceptable Use Policy has been stolen from a legal textbook; his Term [sic] of Service have been stolen from one of God knows how many websites, as has his riddled-with-spelling-mistakes Privacy Policy; and to claim that X3Host is an environmentally-conscious business, he's simply copied and pasted HostUpon's website content lock, stock and barrel.

I can only speak to the position in Britain, but here it's a criminal offence to knowingly infringe someone else's copyright and use that copyrighted work for your own commercial gain. It's punishable by up to 10 years in prison and/or an unlimited fine.

Not planning on coming to the UK for a holiday any time soon are you, FleaBag...?

We have thousands of clients with us , and their websites are running great without any problem , If you are following the following member " MUZIK " and " sihowells "
They are not a clients with us and don't have any services with us, they only posts spam here and we reported them to the mods here.
Nicely compared sihowells. But bear in mind that he will report us to the mods here. I wonder will they be crazy enough to ban 15 Super Vip members for telling the truth about FleaBagHaad?
