Unfortunately most business owners and marketing executives are completely in the dark about this stuff (heck, I was...).

Look, you don't know what you don't know, especially when it comes to the FTC, unless you happen to be an Internet attorney.

OK then, hot-shot. Pop quiz time.

Play along with me...

Take out a pen and paper and answer a simple “yes” or “no” for each of the following:

Are you a digital publisher?
Do you market to, or offer products or services to consumers in the US?
Do you provide coaching services?
Do you have a membership site?
Do you make "free" offers on Facebook or other social media platforms?
Do you use squeeze pages or opt-in pages somewhere?
Do you advertise online?
Do you own a blog?
Do you hire outsourcers?
Do you have images on your website?
If you answered yes to even one of these questions, you are potentially in real danger... No B.S. here.

A good friend of mine, Chip Cooper, is an attorney focusing on Internet Law since the beginning of the Internet. Chip was an adjunct professor at Wake Forest Law School where he taught Internet Law for many years, and currently is the CEO and general counsel of FTC Guardian, an online training company.

This is the only thread on bbhf on the subject and, to me, surprising considering all the marketers on this site.

Not surprising at all, many experienced BBHF members can spot complete BS 1,000 yards out when they know what to look for. Seems he's just another POS (piece of sh*t) in the landscape, ambulance chasing, shiny-suited, 100% lowlife lawyer in fact, looking for commercially unaware clients with a stupid and crappy catch-all sales pitch. If he was a respected valuable attorney, (which he is not) deserving of anyone paying his exorbitant fees, just google him to confirm. Tip: he is not.

I have no axe to bear for or against lawyers, and between BBB and independant professional association sites I cant see any smudge on his record.

I am curious to what I missed: show me your google results to back your giving him a status of 'ambulance chasing, shiny-suited, 100% lowlife lawyer'

Haha, take it easy, champ. This is a generic lawyer description: "just another POS (piece of sh*t) in the landscape, ambulance chasing, shiny-suited, 100% lowlife lawyer" and FYI they _all_ have "smudges" (!) on their record and would likely sell their mother-in-law for the right price. It's not like they have any ethics or moral standards whatsoever. In this day and age, one would be a fool to think so. Suggest you get over it, I have.

I totally agree with We Go that this is such an important subject for marketers that it would be great if someone could share this or start a GB. Bump this!

Bump. This is important for marketers especially in health and money making industries.

Frank Kern (according to him) already had a multi-million dollar business but had to declare bankruptcy and lost everything (houses, cars, etc) because he made a generic claim on one of his sales pages that he couldn't substantiate. So FTC went after him and he lost.

So any product related to this subject in my opinion is very valuable.

I understand that you may have had a problem with a lawyer in the past but there is no reason to make your comment about all people in any respected profession.
Sure there are bad actors in every profession but we should not blindly condemn any profession as doctors, surgeon's, teachers, without prior personal knowledge of their actions.
I have been on his mailing list for several years and he has shared specific legal advice in webinars books and brochures that have helped me.
One of his brochures contained the recommendation of a states attorney general. I did check out the attorney general recommending him and chip' own information.

I just checked google again and have found NOTHING derogatory about him.

How about some FACTS before besmirching and entire profession.
I believe Frank Kern was bankrupted because of the FTC

I have been a customer of Joe Sugarman JSandA ( The Blu Blocker Man) For many years. I have purchased many of his products and have been very happy with them.
In 1979 the FTC opened a case against him for non-delivery of products on time. This case was a witch hunt and they were just looking for a Mail Order company to sue and make an example of to scare other Mail Order companies. The whole case was about a handful of complaints. They wanted to FINE him $275,000 which was absurd. The reason for the complaints has Chicago had a massive snow storm that stopped all employees to get into work. When Joe found out about it he immediately reshipped the products. The FTC would NOT give up and so Joe decided to fight the FTC for all of us small business. He wrote a small book called "The Monster that Eats Business', it depicted the FTC as a giant, hairy monster that pursued JS&A without mercy. He sent this to all his clients. He took out full page ads in the Wall Street Journal explaining his side of the story. This inflamed the FTC even more. Finally, he was allowed to address Congress about FTC abuses. They listened and wrote laws to prevent the FTC from abusing Small Business just like us. Unfortunately, all the legal fees forced him to downsize and his business never recovered.

I taught a college course on How to Start to Operate and Succeed in Your Own Mail Order Business for 20 years and used some of Joe Sugarman books as reference.

Phil, i do not know what your profession is, but I am sure you would not want anyone to besmirched you and your profession without any evidence. Even if Chip is not a great lawyer you should talk about just him, not the whole profession.

I know this was long winded but I think it was important to rebut Phils broad generalization of the legal profession.
