Think of it like breadcrumbs, Google identify sites and methods that are being used (one's they have previously detected) and simply follow the breadcrumbs back to the site that originated it and penalize it (they don't have to be sure just suspect its using unacceptable techniques) Hey they are Google they own their playground.
