If you "hire" Sales People as Independent Contractors in the U.S. this information should be helpful. This has definitely affected the way I deal with IC's. This is the checklist that I personally use. When you read the list you will be surprised at what you read.
The U.S. government is now cracking down on what they refer to as the misclassification of independent contractors and they estimate that millions of IC's are technically employees. Bottom line...They want more tax money.

I wanted to share this because there are a lot of offline marketers that are hiring 100% commissioned sales people. I've seen a number of WSO's and offline training courses that suggest this is the way to scale up. This may be true and therefore I suggest that you fully understand the legal aspects of working with independent contractors.
