It does happen, but not all the time. Sometimes a domain has history on archive.org but it's been bought by someone else. I think the domain's source is godaddy auctions. So by definition, the domains are in auction-- some expired and some aren't. Sometimes the domains have just been registered.
If you try to check each one of the domains though most of them no longer contain the original content that you scrape. Although it's not 100% expired, it's still a great expired article scraper. So I don't see why you'd have to label the thing sh!t if it serves its purpose well. If you wish to use it to "scrape" expired domains for PBN or other purposes, it's not the best tool to have. I suggest you invest your money on register compass or other similar services.
I use this with Copyscape to make sure that the content is not being re-used anywhere else. It can happen.
