Yes, the theme footer is modified and a link was added. The link is going to a website where this guy got the download. It's exactly the same download link, plus the link added in the footer.php exactly reflects the website where it was taken.
So, BE CAREFUL!!!

Did you actually installed and used this theme? If so, checkout your footer.php
I am not certain, however, if removing the line would make it safe just as the original.
