Seriously though mate, just read their TOS, should tell you there. They may kick you off for abuse because your bot flatlined the server but

It is legal as long as you stop spamming when you get complaint. Normally, when you done an aggressive spamming on websites using VPS. The website owner MAY complain to the VPS service provider, which in turn get you kicked out of the VPS. Hence you should use private proxies whenever possible for tools like Xrumer, Scrapebox.
Personally I have conversed to the admins of poweruphosting, hoststage VPS, and have some experiences on using VPS.
